Odpovědnost zaměstnance za škodu na věci dopravované
Obecně lze říci, že pojistitelé při likvidaci škod přiostřují a dříve likvidní škody se nyní pojistiteli mohou jevit jako nepřekonatelný problém. Vzhledem ke značně nepříznivému škodnímu průběhu, který pojistitelé evidují na pojištění odpovědnosti zaměstnanců, nezůstává ani tento druh pojištění výjimkou.
Nyní bychom se chtěli zaměřit na jednu výluku, která se objevuje prakticky ve všech pojistných podmínkách po dlouhou dobu, takže by neměla být nějakým zásadním překvapením. Jedná se o ujednání, které říká, že pojistitel nehradí škody na dopravovaných věcech s výjimkou škod, které se stanou při dopravní nehodě. S takovýmto ujednání se dá asi počítat, neboť na první pohled se nám může zdát, že víme, co se za ním skrývá. Ten druhý pohled, který nám dává pojistitel, může být však překvapující.
Za věc dopravovanou pojistitel považuje i věc, která je například zatím jen nakládána do auta. Je pravda, že taková věc asi jednou bude vozidlem skutečně dopravována, nicméně z pohledu logického výkladu a chápání českého jazyka je dopravovanou věcí jen to, co je opravdu dopravováno. Například pro Českou pojišťovnu je ale logický výklad nedůležitý a své pojistné podmínky doplňuje o výklad pojmu, který je upraven ve zdánlivě se zaměstnancem nesouvisejícím předpisu, a to vyhlášce č. 133/1964 Sb., o přepravním řádu. Podle této vyhlášky má odesílatel nárok, aby dopravce v rámci dopravy provedl také nakládku a vykládku, a to až do vzdálenosti 5 m od vozidla. Nakládka a vykládka jsou tedy považovány za povinnou součást dopravy a věc, kterou dopravce převzal k nakládce, je od tohoto okamžiku považována za věc dopravovanou, a to až do skončení vykládky navazující na samotnou přepravu věci z místa na místo. Jinými slovy, je úplně jedno, že váš zaměstnavatel není dopravcem, a je úplně jedno, že ve vašem pracovním vztahu nefiguruje žádný dopravce ani odesílatel. Pokud se škoda při nakládání či vykládání stane do pěti metrů od vozidla, pak se jedná o věc dopravovanou a škoda na ní není z pojištění likvidní.
Hodnocení tohoto výkladu si každý může udělat sám. Osobně bychom doporučovali pojistitele, který používá takové výklady, vyměnit za jiného. Pokud takového pojistitel již máte a nemůžete jej změnit, pak doporučujeme nepoškozovat věci při nakládání a vykládání, nebo doporučujeme změřit vzdálenost od vozidla na víc než pět metrů.

The Black and silver dress in the coat rack scene was the “Tango Fringe Dress” from LeuloeClxthing.com. Mark Bridges shortened the fringe slightly. The other beaded dress pictured with the diamond shapes on it was actually a “Midnight Blue Garconne” from Leluxe as well. It was untouched, off the rack, as we have sold it for years. I will be making this in Pewter to match the black and white look of the movie, but the dress was actually dark blue.
I want to express some appitcraeion to you just for bailing me out of such a setting. I don’t know what I would have done if I hadn’t encountered such a subject like this. If your two-finger scrolling isn't working, then try to power cycle the device. That is what worked for me (its a good idea to do it anyway after an update).Scrolling seems better afterwards as well!

I have problem loading my videos though after you change this…Either the video loads fully until the end. Then when I click to replay it, it wouldn't work and RE-loads itself. Another problem I encounter is that some shows it loads full but when I click to play it, it only plays for a few seconds then just stop right there. Then when I try to push the circle button back with mouse, the whole thing stops! I can't play it with the play button and it just doesn't move! Please fix this! TT
